Validity
These General Terms and Conditions (GTC) apply to the contractual relationship between Umzug-247.de (the representing company and the subpages of Umzug-247.de, hereinafter referred to only as Umzug-247.de) and the users. Users are all natural or legal persons who submit an enquiry for a service via Umzug-247.de in order to receive up to six quotes from service providers.
The Enquiry
- Submitting an enquiry is free of charge and non-binding.
- If the user submits an enquiry for a service, a contract is concluded for the brokering of up to six quotes from service providers.
- After the enquiry has been submitted, it is forwarded to the selected service providers (up to six).
- If necessary, the service providers may contact the user first in order to specify the enquiry further together with them.
The Quotes
- The service providers submit suitable quotes to the user and contact the user about them by telephone or e-mail.
- In most cases, the user receives up to six quotes within twenty-four hours (often at weekends or in the evening as well).
- The user receives quotes from service providers who are members of the Umzug-247.de service provider network. Each service provider undertakes towards Umzug-247.de to comply with all relevant guidelines of chambers of trades, professional associations and comparable institutions, and to offer only products or services for which they are authorised.
- After the user has received the quotes, they decide for themselves whether, and from which service provider, they accept a quote.
Warranty and Limitations of Service
- Umzug-247.de cannot guarantee that a suitable service provider will be found for every enquiry. If no suitable service provider is found for the user, Umzug-247.de will notify the user by e-mail.
- Receiving a certain number of quotes is not guaranteed. If the user has not yet received any quotes within twenty-four hours, the user may contact Umzug-247.de.
- How quickly the user receives quotes depends on the complexity of the requested service and on the processing time of the respective service provider.
- Umzug-365.de cannot guarantee the suitability of every service provider in individual cases. The user must therefore check the suitability of the service provider in the same way as they would when obtaining quotes without Umzug-247.de.
- If the user accepts one of the quotes, Umzug-247.de is in no case a party to the contract and does not act as a representative or agent of the contracting parties.
- Umzug-247.de owes neither the conclusion of a contract nor its successful performance. Umzug-247.de’s warranty in this respect is excluded.
- Umzug-247.de is not responsible for breaches of duty arising within the scope of any contractual relationship that may have come into existence between the user and the service provider.
- The service provider may use the enquiries exclusively for the one-time preparation of a quote. Any further storage or use of the enquiry data is expressly prohibited (data protection).
Obligations of the User
- The brokering service of Umzug-247.de is free of charge for the user.
- The Umzug-247.de service may be used by all natural and legal persons who have unrestricted legal capacity. Natural persons who have not reached the age of 18 are not permitted to use it. If the user submits an enquiry on behalf of a legal person, they also confirm that they are authorised to represent that legal person.
Liability and Warranty
- Umzug-247.de is not liable for the content of, or the moving contract concluded between, the customer and the service provider. No checks or similar are carried out in this regard.
- In cases of fraud, the private customer may forward a court judgment to Umzug-247.de. If the matter concerns an enquiry brokered via Umzug-247.de, the partner will be terminated without notice.
Final Provisions
- Conflicting terms and conditions of the users shall not be recognised without written confirmation from Umzug-247.de. Additions and amendments to these GTC must be made in writing.
- The place of performance is Frankfurt am Main. The place of jurisdiction is Frankfurt am Main, provided the user is a merchant or a legal entity under public law.
- The contract language is German.
- The law of the Federal Republic of Germany applies. This does not apply where mandatory consumer protection provisions conflict with it.
- Should any provision of these GTC or of other contractual agreements between the users and Umzug-247.de prove to be invalid, or become invalid due to a subsequent development, the remaining provisions shall remain unaffected.
- An invalid provision or any gap in the regulations shall be replaced by the statutory provisions.
